holding down the house in Room 303 of the Cook County Courthouse in Chicago, IL &#8211; ruled the Illinois terrorism statute <a href=\"http:\/\/www.scribd.com\/doc\/132710689\/Order-Denying-Motion-to-Dismiss-Facial-Challenge-to-IL-Terrorism-Statute\">constitutional on its face<\/a>.<\/p>\n<p><a href=\"https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/TWilson.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-18976 alignright\" alt=\"TWilson\" src=\"https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/TWilson.jpg\" width=\"250\" height=\"300\" \/><\/a><\/p>\n<p>This ruling was issued approximately two months after the attorneys defending the three clients known as the &#8220;<a href=\"http:\/\/truth-out.org\/news\/item\/9254-terrorism-plot-or-entrapment-the-case-of-the-nato-3\">NATO 3<\/a>&#8221; issued a <a href=\"http:\/\/truth-out.org\/news\/item\/14831-nato-3-case-challenges-constitutionality-of-state-terrorism-statutes\">motion and memorandum arguing the law defied the dictates of the First Amendment<\/a>\u00a0because it is overly-broad as currently written, an argument rejected by Wilson.<\/p>\n<p>Thus, it was confirmed that the three activists &#8211; <a href=\"http:\/\/www.suntimes.com\/news\/crime\/12639710-418\/black-bloc-profile-jared-chase-has-done-dumb-things-but-nothing-like-this.html\">Jared Chase<\/a> from Keene, NH; <a href=\"http:\/\/www.suntimes.com\/news\/crime\/12639622-418\/black-bloc-profile-brent-vincent-betterly-inspired-by-revolutionaries.html\">Brent Betterly<\/a> from Fort Lauderdale, FL; and <a href=\"http:\/\/www.suntimes.com\/news\/crime\/12639678-418\/black-bloc-profile-brian-church-allegedly-asked-ever-see-a-cop-on-fire.html\">Brian Church<\/a> also from\u00a0Fort Lauderdale &#8211; who were in the Windy City to protest the May 2012 NATO Summit <a href=\"http:\/\/www.scribd.com\/doc\/132710689\/Order-Denying-Motion-to-Dismiss-Facial-Challenge-to-IL-Terrorism-Statute\">will be charged by the State of Illinois with three counts<\/a> of &#8220;conspiracy to commit terrorism,&#8221; &#8220;material support for terrorism,&#8221; and possession of an incendiary device (allegedly molotov cocktails) to &#8220;commit the offense of terrorism.&#8221;<\/p>\n<p><a href=\"https:\/\/antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/NATO-3-mug-shots.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-18977 alignleft\" alt=\"NATO-3-mug-shots\" src=\"https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/NATO-3-mug-shots-300x105.jpg\" width=\"300\" height=\"105\" srcset=\"https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/NATO-3-mug-shots-300x105.jpg 300w, https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/NATO-3-mug-shots.jpg 639w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p><strong>&#8220;Mo&#8221; and &#8220;Gloves&#8221;<\/strong><\/p>\n<p><a href=\"http:\/\/www.scribd.com\/doc\/132710689\/Order-Denying-Motion-to-Dismiss-Facial-Challenge-to-IL-Terrorism-Statute\">Mentioned only obliquely by Wilson in his ruling<\/a>: two undercover police informants who played a role in pushing the terrorism plot forward, potentially manufacturing it wholesale and then slapping the label &#8220;terrorism&#8221; on it.<\/p>\n<p>Known in Chicago activist circles in the run-up to the NATO Summit as &#8220;<a href=\"http:\/\/truth-out.org\/news\/item\/9273-more-nato-summit-activists-charged-five-linked-by-two-informants\">Mo<\/a>&#8221; and <a href=\"http:\/\/antiwar.com\/blog\/2012\/05\/22\/pictures-of-second-nato-5-informant-gloves-published-for-first-time-on-antiwar-com\/\">&#8220;Nadia&#8221;\/&#8221;Gloves,&#8221;<\/a> Nadia is <a href=\"http:\/\/www.scribd.com\/doc\/132710689\/Order-Denying-Motion-to-Dismiss-Facial-Challenge-to-IL-Terrorism-Statute\">mentioned directly but not by name<\/a> in Wilson&#8217;s ruling as someone &#8220;believed [to be a] co-conspirator&#8221; when Church asked her if she was &#8220;ready to see a cop on fire&#8221; in the days leading up to the Summit.<\/p>\n<p><a href=\"https:\/\/antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/Gloves-and-Mo-Together.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-18978 alignright\" alt=\"Gloves and Mo Together\" src=\"https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/Gloves-and-Mo-Together-199x300.jpg\" width=\"199\" height=\"300\" srcset=\"https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/Gloves-and-Mo-Together-199x300.jpg 199w, https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/Gloves-and-Mo-Together.jpg 250w\" sizes=\"(max-width: 199px) 100vw, 199px\" \/><\/a><\/p>\n<p>&#8220;Nadia&#8221; wore a hidden recording device while having a slew of meetings with the &#8220;NATO 3&#8221; from May 1-May 16, 2012, the audio from which has been used as the evidence for the prosecution of the three.<\/p>\n<p>&#8220;We think the terrorism charges should&#8217;ve never been brought in the first place,&#8221; <a href=\"http:\/\/peopleslawoffice.com\/about-civil-rights-lawyers\/attorney-staff-bios\/michael-e-deutsch\/\">Michael Deutsch<\/a> of the <a href=\"http:\/\/peopleslawoffice.com\/\"><em>People&#8217;s Law Office<\/em><\/a>, an attorney co-representing Brian Church with Gelsomino, said in an interview. &#8220;It&#8217;s not a terrorism case, it never was and it never should&#8217;ve been &#8211; it&#8217;s politically-motivated use for improper purposes.&#8221;<\/p>\n<p><strong>The Scene From Within<\/strong><\/p>\n<p>The hearing unfolded roughly a week after a <a href=\"http:\/\/www.truth-out.org\/news\/item\/15277-nato-3-oral-argument-unfolds-on-illinois-terrorism-statutes-constitutionality\">key oral argument between the two parties<\/a>, lasting a mere 15 minutes in a small circular room featuring a painting of Martin Luther King, Jr. resting on the wall behind the left shoulder of Judge Wilson. Held in a room sealed off by sound-proof glass, the sound inside the courtroom was projected via a microphone and the speakers sitting on the other side of that glass.<\/p>\n<p>Three uniformed police officers sat with the defendants in the front room and another four stood with the audience in the glassed-off back room featuring two columns of wooden church-like pews that ran three rows deep. Roughly 20 Chicago-area activists came out in support of the activists, many of them donning yellow shirts in solidarity with the &#8220;NATO 3,&#8221; two out of three who were also ushered out in yellow &#8220;protective-custody-level&#8221; IL Department of Corrections (DOC) prison garb.<\/p>\n<p>&#8220;It&#8217;s what a lot of scholars and people who pay attention to national security call the &#8216;new normal.&#8217; That is, because the terrorism statute is in play, you end up having police officers sitting in bullet proof vests in the court room,&#8221; attorney <a href=\"http:\/\/www.durkinroberts.com\/thomasdurkin.html\">Thomas Durkin<\/a> of <a href=\"http:\/\/www.durkinroberts.com\/\"><em>Durkin &amp; Roberts<\/em><\/a>, representing Jared Chase,\u00a0said in an interview. &#8220;Over time, you&#8217;ve got what legal scholars call &#8216;seepage,&#8217; in which these &#8216;new normals&#8217; start seeping into the court room incrementally.&#8221;<\/p>\n<p>The hearing had an ominous feeling from jump street, with the State of Illinois bringing a nine-person cadre to Chicago, much bigger than the usual three-person team attending the hearings so far. Prior to the hearing&#8217;s commencement, People&#8217;s Law Office<span style=\"font-size: 13px;\"> attorney\u00a0<\/span><a style=\"font-size: 13px;\" href=\"http:\/\/peopleslawoffice.com\/about-civil-rights-lawyers\/attorney-staff-bios\/sarah-gelsomino\/\">Sarah Gelsomino<\/a>, co-representing Brian Church, came to the attendants&#8217; gallery and told supporters to remain calm because the ruling would likely not be favorable &#8211; a doomsaying hypothesis which merely 15 minutes later proved true.<\/p>\n<p><strong>Court Date Set for Two-Year\u00a0Anniversary\u00a0of Occupy Wall Street<\/strong><\/p>\n<p>Two other activists charged with similar crimes, Mark Neiweem and Sebastian Senakiewicz &#8211; part of the broader &#8220;<a href=\"http:\/\/truth-out.org\/news\/item\/9273-more-nato-summit-activists-charged-five-linked-by-two-informants\">NATO 5&#8243;<\/a> &#8211; also are still sitting in\u00a0Cook County Jail with the &#8220;NATO 3&#8221; awaiting their final destiny. The Jail was <a href=\"http:\/\/www.nytimes.com\/2008\/07\/18\/us\/18cook.html?_r=2&amp;\">under federal investigation for its conditions in 2008<\/a>.<\/p>\n<p><a href=\"https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/sebastian-senakiewicz-and-mark-neiweem-0520.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-18979 alignleft\" alt=\"sebastian-senakiewicz-and-mark-neiweem-0520\" src=\"https:\/\/www.antiwar.com\/blog\/wp-content\/uploads\/2013\/03\/sebastian-senakiewicz-and-mark-neiweem-0520.jpg\" width=\"300\" height=\"225\" \/><\/a><\/p>\n<p>A final trial date for the &#8220;NATO 3&#8221; is <a href=\"http:\/\/antiwar.com\/blog\/2012\/11\/22\/nato-3-court-date-set-for-one-day-before-two-year-anniversary-of-occupy-wall-street\/\">still set for Sept. 16, 2013<\/a>, the day before the two-year anniversary of the launch of the Occupy Wall Street movement.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Chicago, IL Judge Thaddeus Wilson &#8211; holding down the house in Room 303 of the Cook County Courthouse in Chicago, IL &#8211; ruled the Illinois terrorism statute constitutional on its face.
