{"id":22763,"date":"2014-01-23T08:36:18","date_gmt":"2014-01-23T16:36:18","guid":{"rendered":"http:\/\/antiwar.com\/blog\/?p=22763"},"modified":"2014-01-23T08:47:04","modified_gmt":"2014-01-23T16:47:04","slug":"nsa-bulk-metadata-collection-is-illegal-government-oversight-board","status":"publish","type":"post","link":"https:\/\/www.antiwar.com\/blog\/2014\/01\/23\/nsa-bulk-metadata-collection-is-illegal-government-oversight-board\/","title":{"rendered":"NSA Bulk Metadata Collection Is Illegal: Government Oversight Board"},"content":{"rendered":"<p>The NSA&#8217;s bulk collection of every American&#8217;s telephone call records is illegal, <a href=\"http:\/\/www.nytimes.com\/2014\/01\/23\/us\/politics\/watchdog-report-says-nsa-program-is-illegal-and-should-end.html?nl=todaysheadlines&amp;emc=edit_th_20140123&amp;_r=0\">according to<\/a> the federal government&#8217;s independent review panel,\u00a0the\u00a0Privacy and Civil Liberties Oversight Board.<\/p>\n<p>The NSA&#8217;s interprets Section 215 of the Patriot Act, which\u00a0permits the F.B.I. to obtain business records deemed \u201crelevant\u201d to an investigation, as granting it the authority to collect the call records of all Americans and hold them for years for querying. The Oversight Board says no dice.<\/p>\n<p><a href=\"http:\/\/www.nytimes.com\/2014\/01\/23\/us\/politics\/watchdog-report-says-nsa-program-is-illegal-and-should-end.html?nl=todaysheadlines&amp;emc=edit_th_20140123&amp;_r=0\"><em>New York Times<\/em><\/a>:<\/p>\n<blockquote><p>An independent federal privacy watchdog has concluded that the\u00a0<a title=\"More articles about National Security Agency, U.S.\" href=\"http:\/\/topics.nytimes.com\/top\/reference\/timestopics\/organizations\/n\/national_security_agency\/index.html?inline=nyt-org\">National Security Agency<\/a>\u2019s program to collect bulk phone call records has provided only \u201cminimal\u201d benefits in counterterrorism efforts, is illegal and should be shut down.<\/p>\n<p itemprop=\"articleBody\" data-para-count=\"344\" data-total-count=\"2043\">&#8230;The program \u201clacks a viable legal foundation under Section 215, implicates constitutional concerns under the First and Fourth Amendments, raises serious threats to privacy and civil liberties as a policy matter, and has shown only limited value,\u201d the report said. \u201cAs a result, the board recommends that the government end the program.\u201d<\/p>\n<\/blockquote>\n<p itemprop=\"articleBody\" data-para-count=\"344\" data-total-count=\"2043\">It&#8217;s hard to get any clearer than that, but it&#8217;s worth remembering that this review panel isn&#8217;t alone. This comes on the heels of <a href=\"http:\/\/apps.washingtonpost.com\/g\/page\/world\/federal-judge-rules-nsa-program-unconstitutional\/668\/?Post+generic=%3Ftid%3Dsm_twitter_washingtonpost\">the ruling<\/a> by\u00a0U.S. District Court Judge Richard Leon that the phone metadata program is &#8220;almost certainly&#8221; unconstitutional.<\/p>\n<p itemprop=\"articleBody\" data-para-count=\"344\" data-total-count=\"2043\">A ruling from the\u00a0<a href=\"http:\/\/www.nytimes.com\/2013\/08\/22\/us\/2011-ruling-found-an-nsa-program-unconstitutional.html\">FISA court<\/a>\u00a0in 2011\u00a0found that the NSA \u201cfrequently and systematically violated\u201d statutory laws governing how intelligence agents can search databases of Americans\u2019 telephone communications and that NSA analysts deliberately misled judges about their surveillance activities in order to get court approval.<\/p>\n<p itemprop=\"articleBody\" data-para-count=\"344\" data-total-count=\"2043\">There is also bipartisan agreement in Congress that the NSA has systematically violated the law. Rep. Jim Sensenbrenner (R-WI), the author of the Patriot Act, including its Section 2015, <a href=\"http:\/\/sensenbrenner.house.gov\/news\/documentsingle.aspx?DocumentID=341673\">has said<\/a> from the beginning that the NSA&#8217;s bulk metadata collection program exceeds the authority of the law.\u00a0Senator Ron\u00a0Wyden (D-OR), who is on the Senate Intelligence Committee and has access to classified information about the NSA\u2019s surveillance practices,\u00a0<a href=\"http:\/\/communities.washingtontimes.com\/neighborhood\/john-glaser-intelligence-foreign-policy-world\/2013\/oct\/9\/sen-wyden-seeks-scale-back-nsa-surveillance\/\">said in October<\/a>\u00a0that even with the overly broad statutory powers granted to the NSA, \u201cthe rules have been broken, and the rules have been broken a lot.\u201d<\/p>\n<p itemprop=\"articleBody\" data-para-count=\"344\" data-total-count=\"2043\">&#8220;We welcome the board\u2019s report, and we agree with is principal conclusions,&#8221; the ACLU said in a statement. &#8220;The NSA\u2019s call-records dragnet is illegal and ineffective and presents a serious threat to civil liberties.&#8221;<\/p>\n<p itemprop=\"articleBody\" data-para-count=\"344\" data-total-count=\"2043\">Sorry to ask such a 5th grade Social Studies question, but&#8230;what is it that&#8217;s supposed to happen when people violate the law?
