{"id":38473,"date":"2021-12-08T19:35:24","date_gmt":"2021-12-09T03:35:24","guid":{"rendered":"https:\/\/www.antiwar.com\/blog\/?p=38473"},"modified":"2021-12-08T19:35:24","modified_gmt":"2021-12-09T03:35:24","slug":"as-senate-holds-guantnamo-hearing-biden-urged-to-finally-end-this-chapter-of-injustice","status":"publish","type":"post","link":"https:\/\/www.antiwar.com\/blog\/2021\/12\/08\/as-senate-holds-guantnamo-hearing-biden-urged-to-finally-end-this-chapter-of-injustice\/","title":{"rendered":"As Senate Holds Guant&aacute;namo Hearing, Biden Urged to &#8216;Finally End This Chapter of Injustice&#8217;"},"content":{"rendered":"<p>Human rights defenders on Tuesday renewed demands for President Joe Biden to close the U.S. military prison at Guant&aacute;namo Bay, Cuba as the Senate Judiciary Committee convened a hearing at which experts and advocates testified about the damage that Gitmo does to detainees, the nation&#8217;s standing in the world, and the elusive pursuit of justice for victims of the September 11, 2001 terror attacks and their families.<\/p>\n<p>Lamenting that two-third of the remaining 39 Guant&aacute;namo prisoners &#8211; there have been <a href=\"https:\/\/www.andyworthington.co.uk\/guantanamo-the-definitive-prisoner-list-part-1\/\">approximately 780<\/a> men and boys held at the facility since 2002 &#8211; have not been charged with any crime, Senate Judiciary Chair Dick Durbin (D-Ill.) asked, &#8220;How can that possibly be justice?&#8221;<\/p>\n<p>&#8220;The story of Guant&aacute;namo is the story of a nation that lost its way,&#8221; said Durbin, to the <a href=\"https:\/\/twitter.com\/Dr_Maha_Hilal\/status\/1468260239229308929\">protestations<\/a> of observers who noted that <a href=\"https:\/\/www.commondreams.org\/views\/2019\/06\/21\/brief-history-us-concentration-camps\">indefinite detention<\/a> and <a href=\"https:\/\/www.counterpunch.org\/2018\/05\/08\/a-brief-history-of-american-torture\/\">torture<\/a> have been part of the US narrative for centuries. &#8220;It is a story of justice delayed and denied again and again &#8211; not only for detainees but also for the victims of 9\/11 and their loved ones.&#8221;<\/p>\n<p><!--more--><\/p>\n<p>&#8220;There is no end in sight for these military commissions,&#8221; he added, referring to the legal apparatus for prosecuting Gitmo detainees that was <a href=\"https:\/\/www.thenation.com\/article\/archive\/rigged-trials-gitmo\/\">described<\/a> as &#8220;rigged&#8221; by one of several US military prosecutors who quit in protest. &#8220;We can and we must do better.&#8221;<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">WATCH LIVE: The Committee holds a hearing entitled \u201cClosing Guantanamo: Ending 20 Years of Injustice.\u201d This prison has been a stain on our international reputation and does nothing to bring justice for the victims of 9\/11. It&#39;s time to <a href=\"https:\/\/twitter.com\/hashtag\/CloseGuantanamo?src=hash&amp;ref_src=twsrc%5Etfw\">#CloseGuantanamo<\/a><a href=\"https:\/\/t.co\/szFErl4Tdz\">https:\/\/t.co\/szFErl4Tdz<\/a><\/p>\n<p> &mdash; Senate Judiciary Committee (@JudiciaryDems) <a href=\"https:\/\/twitter.com\/JudiciaryDems\/status\/1468234034530586624?ref_src=twsrc%5Etfw\">December 7, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Last week, Durbin <a href=\"https:\/\/www.commondreams.org\/news\/2021\/11\/30\/durbin-introduces-amendment-end-legacy-cruelty-closing-guantanamo\">announced<\/a> that he had introduced an amendment to the 2022 National Defense Authorization Act that, if passed, would close Guant&aacute;namo &#8220;once and for all.&#8221;<\/p>\n<p>Michael Lehnert, the retired US Marine Corps general who was Gitmo&#8217;s first commander and who later became an <a href=\"https:\/\/www.upi.com\/Top_News\/US\/2013\/12\/12\/First-Guantanamo-commander-says-shutdown-is-overdue\/82941386884670\/\">outspoken advocate<\/a> for its closure, testified Tuesday that the Biden administration should appoint an official tasked with shutting down the prison.<\/p>\n<p>&#8220;Make someone in the White House currently responsible for closure and give them a finite period of time to make it happen,&#8221; Lehnert told the senators. &#8220;I was given 96 hours to open it. Ninety-six days to close it seems reasonable.&#8221;<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">With the Senate holding a hearing on Guant\u00e1namo today for the first time in 6 years, it\u2019s important to remember that President Biden has the power to finally close the prison responsibly. It is a shameful symbol of racial injustice, torture, and violations of the Constitution and international law. It&#8217;s time to finally <a href=\"https:\/\/twitter.com\/search?q=%23closeguantanamo&amp;src=typed_query\">#CloseGuantanamo<\/a>.&#8221;<\/p>\n<p>&#8220;Each day that Guant&aacute;namo remains open is a stain on the moral fiber of America,&#8221; the group asserted, adding that at a cost of $540 million per year, Gitmo is &#8220;the most expensive prison on Earth.&#8221;<\/p>\n<p>The Friends Committee on National Legislation (FCNL), a Quaker advocacy group, <a href=\"https:\/\/twitter.com\/FCNL\/status\/1467952341244645379\">stressed<\/a> ahead of the hearing that &#8220;President Biden has the power to finally end this chapter of injustice&#8221; and urged &#8220;no more inaction.&#8221;<\/p>\n<p>The Biden administration &#8211; which has <a href=\"https:\/\/www.commondreams.org\/news\/2021\/02\/12\/end-human-rights-atrocity-says-amnesty-after-biden-admin-signals-goal-close-gitmo\">signaled its intention<\/a> to close Guant&aacute;namo &#8211; did not send a representative to Tuesday&#8217;s hearing.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">It&#39;s really astounding that the Biden administration couldn&#39;t be bothered to send anyone to testify at this Senate Judiciary Committee oversight hearing.<\/p>\n<p> &mdash; Daphne Eviatar (@deviatar) <a href=\"https:\/\/twitter.com\/deviatar\/status\/1468239599201882119?ref_src=twsrc%5Etfw\">December 7, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>The Center for Constitutional Rights (CCR), which has represented Guant&aacute;namo prisoners in two U.S. Supreme Court cases as well as numerous other Gitmo detainees, <a href=\"https:\/\/www.commondreams.org\/newswire\/2021\/12\/07\/if-president-biden-wants-end-forever-war-he-must-close-guantanamo-gitmo-lawyers\">said<\/a> in a statement that &#8220;today&#8230; our co-counsel Katya Jestin testified about our client, Majid Khan, and the lessons learned from his case about how to resolve the failed military commissions&#8230; and close the prison.&#8221;<\/p>\n<p>&#8220;She discussed the negotiated resolution of Khan&#8217;s case and the completion of his military commission sentence in February 2022, after which he will need to be transferred from Guant&aacute;namo,&#8221; the group related. &#8220;She also <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/Jestin%20Testimony.pdf\" target=\"_blank\" rel=\"noopener\">addressed<\/a> Khan&#8217;s torture in CIA detention, which included waterboarding and <a href=\"https:\/\/theconversation.com\/rectal-feeding-is-rape-but-dont-expect-the-cia-to-admit-it-35437\" target=\"_blank\" rel=\"noopener\">rape<\/a>, echoing both Khan&#8217;s <a href=\"https:\/\/ccrjustice.org\/home\/press-center\/press-releases\/new-details-torture-cia-black-sites\">own statement<\/a> last month and <a href=\"https:\/\/twitter.com\/SenatorDurbin\/status\/1465705373071937553?s=20\" target=\"_blank\" rel=\"noopener\">remarks<\/a> by committee Chair Sen. Durbin.&#8221;<\/p>\n<p>&quot;While Mr. Khan is unique in having had the opportunity to tell his story publicly, he is not alone,&quot; CCR&#8217;s statement continued. &quot;A total of 26 survivors of the CIA&#8217;s torture and detention program, including our client <a href=\"https:\/\/ccrjustice.org\/sharqawi-al-hajj\">Sharqawi Al Hajj<\/a>, are imprisoned at Guant&aacute;namo. Like more than two-thirds of the 39 men still held there, Mr. Al Hajj is not charged with a crime, and he is one of several suffering life-threatening health problems &#8211; a result, in part, of his torture.&quot;<\/p>\n<p>&quot;Another of our clients, <a href=\"https:\/\/ccrjustice.org\/sufyian-barhoumi\">Sufyian Barhoumi<\/a>, is one of the 13 men still languishing at Guant&aacute;namo even though they have been cleared for transfer,&quot; the group added. &quot;While it might be easy to assume the remaining men are the most difficult cases who cannot be sent anywhere, that is far from true.
