In an interview on last Sunday’s 60 Minutes<\/em><\/a>, Leslie Stahl asked if the term “cruel and unusual punishment” applies to someone “being brutalized by a law enforcement person,” Scalia replied:<\/p>\n

“To the contrary, has anybody ever referred to torture as punishment? I don’t think so.” <\/strong><\/p><\/blockquote>\n

The exchange continued:<\/p>\n

“Well, I think if you are in custody, and you have a policeman who’s taken you into custody\u00e2\u20ac\u00a6,” Stahl says. <\/p>\n

“And you say he’s punishing you?” Scalia asks. <\/p>\n

“Sure,” Stahl replies. <\/p>\n

“What’s he punishing you for? You punish somebody\u00e2\u20ac\u00a6,” Scalia says. <\/p>\n

“Well because he assumes you, one, either committed a crime\u00e2\u20ac\u00a6or that you know something that he wants to know,” Stahl says. <\/p>\n

“It’s the latter. And when he’s hurting you in order to get information from you\u00e2\u20ac\u00a6you don\u00e2\u20ac\u2122t say he’s punishing you. What\u00e2\u20ac\u2122s he punishing you for? He’s trying to extract\u00e2\u20ac\u00a6,” Scalia says. <\/p>\n

“Because he thinks you are a terrorist and he’s going to beat the you-know-what out of you\u00e2\u20ac\u00a6,” Stahl replies. <\/p>\n
