Only one\u2014Ali Hamza Ahmad Suliman al-Bahlul, a Yemeni national\u2014has ever been convicted of terrorism-related charges under the highly controversial military commission regime established by the George W. Bush administration in the wake of the September 11, 2001 attacks on the United States.<\/p>\n<p><!--more--><\/p>\n<p>&#8220;It is outrageous that 22 years after the U.S. government opened the Guant\u00e1namo detention camp to detain Muslim men beyond the reach of U.S. law, that this abuse of human rights continues today,&#8221; Daphne Eviatar, director of the Security with Human Rights program at <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/tag\/amnesty-international\">Amnesty International<\/a> USA, said in a statement.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">If the last time you were free was 2002, the world looked like this&#8230;<\/p>\n<p>After 22 years, the US government must finally live up to its promises and close the Guantanamo prison for good. Former President Barack Obama\u2014under whom Biden served as vice president\u2014issued executive orders immediately after taking office in 2009 that were meant to <a class=\"rm-stats-tracked\" href=\"https:\/\/www.federalregister.gov\/documents\/2009\/01\/27\/E9-1885\/ensuring-lawful-interrogations\" target=\"_blank\" rel=\"noopener noreferrer\">end torture<\/a> and <a class=\"rm-stats-tracked\" href=\"https:\/\/www.federalregister.gov\/documents\/2009\/01\/27\/E9-1893\/review-and-disposition-of-individuals-detained-at-the-guantaacutenamo-bay-naval-base-and-closure-of\" target=\"_blank\" rel=\"noopener noreferrer\">close Gitmo.<\/a> However, Obama was <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/2017\/01\/18\/thats-it-eight-years-later-obama-white-house-admits-gitmo-wont-close\" target=\"_self\" rel=\"noopener\">blocked by Congress<\/a> from proceeding with his plan to close the prison, frustrating his <a class=\"rm-stats-tracked\" href=\"https:\/\/www.inquirer.com\/philly\/blogs\/attytood\/Barack_on_torture.html\" target=\"_blank\" rel=\"noopener noreferrer\">campaign promise<\/a>. Obama was also accused of <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/2015\/12\/01\/without-prosecution-bush-officials-obama-legacy-forever-poisoned\" target=\"_blank\" rel=\"noopener\">breaking the law<\/a> by <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/2014\/03\/13\/amid-senate-skirmish-obama-continues-shield-cia-and-bush-era-torture\" target=\"_self\" rel=\"noopener\">actively shielding <\/a>Bush-era <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/views\/2009\/05\/18\/13-people-who-made-torture-possible\" target=\"_self\" rel=\"noopener\">officials<\/a> from facing justice for their roles in torture at Gitmo and other military prisons and CIA so-called &#8220;black sites.&#8221;<\/p>\n<p>Shortly after Biden took office, the White House <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/2021\/02\/12\/end-human-rights-atrocity-says-amnesty-after-biden-admin-signals-goal-close-gitmo\" target=\"_blank\" rel=\"noopener\">signaled<\/a> it wanted to close Guant\u00e1namo. However, despite releasing 10 detainees, the administration has taken few steps toward achieving that goal and has spent millions of dollars <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/2021\/12\/30\/anti-democratic-and-cowardly-us-building-new-secret-courtroom-guantanamo\" target=\"_blank\" rel=\"noopener\">expanding<\/a> the facility by building a courtroom where prisoners are meant to be tried in secret.<\/p>\n<p>However, the military commissions\u2014which former lead prosecutor Col. Morris Davis <a class=\"rm-stats-tracked\" href=\"https:\/\/www.thenation.com\/article\/archive\/rigged-trials-gitmo\/\" target=\"_blank\" rel=\"noopener noreferrer\">called<\/a> &#8220;rigged from the start&#8221;\u2014have been stymied by the torture endured by defendants at the hands of military and CIA operatives. Military judges have <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/ramzi-bin-al-shibh\" target=\"_blank\" rel=\"noopener\">barred<\/a> Guant\u00e1namo detainees or evidence in terrorism cases from the courtroom due to torture.<\/p>\n<p>This has been a major impediment to bringing terrorism suspects to justice. For example, Col. Stuart Crouch, a Guant\u00e1namo prosecutor whose Marine Corps buddy was a pilot on one of the planes that crashed into the World Trade Center on 9\/11, <a class=\"rm-stats-tracked\" href=\"https:\/\/www.wsj.com\/amp\/articles\/SB117529704337355155\" target=\"_blank\" rel=\"noopener noreferrer\">refused to prosecute <\/a>Mohamedou Ould Slahi\u2014who allegedly helped organize the plane&#8217;s hijacking\u2014because Ould Slahi was <a class=\"rm-stats-tracked\" href=\"https:\/\/www.nytimes.com\/2021\/09\/12\/us\/politics\/torture-post-9-11.html\" target=\"_blank\" rel=\"noopener\">tortured.<\/a><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/Guantanamo22?src=hash&amp;ref_src=twsrc%5Etfw\">#Guantanamo22<\/a><a href=\"https:\/\/twitter.com\/hashtag\/CloseGuntanamoNow?src=hash&amp;ref_src=twsrc%5Etfw\">#CloseGuntanamoNow<\/a><br \/>Today, 2002, the sun-scorched tarmac of Guantanamo welcomed 20 prisoners, shackled, hooded, and silenced\u2014a sinister prelude to what became the US&#39;s most infamous, extra-judicial prison. 22 years later, it stands as a living testament to humanity&#39;s\u2026 <a href=\"https:\/\/t.co\/rjKuHtZoGV\">pic.twitter.com\/rjKuHtZoGV<\/a><\/p>\n<p>&mdash; in Afghanistan.<\/p>\n<p>Davis and at least four other military prosecutors requested and were granted removal from the military commissions because they felt the proceedings were unfair and marred by torture.<\/p>\n<p>Among the Guant\u00e1namo detainees cleared for release are &#8220;forever prisoner&#8221; <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/abu-zubaydah-drawings\" target=\"_blank\" rel=\"noopener\">Abu Zubaydah<\/a>, who has been imprisoned at Gitmo for 21 years without charge and was the first known victim of waterboarding.<\/p>\n<p>&#8220;More than half of those who remain are men the United States itself does not believe need to be detained,&#8221; the Center for Constitutional Rights\u2014which represents some Guant\u00e1namo detainees\u2014said in a <a class=\"rm-stats-tracked\" href=\"https:\/\/ccrjustice.org\/home\/press-center\/press-releases\/guant-namo-turns-22-president-biden-must-turn-failure-action\" target=\"_blank\" rel=\"noopener\">statement<\/a> Thursday. &#8220;The fact that they continue to languish after two decades is a cruelty that could end tomorrow.&#8221;<\/p>\n<p>&#8220;The Biden administration needs no new authority or ideas,&#8221; although he did not transfer anyone to the prison.<\/p>\n<p>On Tuesday, scores of rights groups <a class=\"rm-stats-tracked\" href=\"https:\/\/www.cvt.org\/statements\/cvt-and-coalition-partners-call-on-president-biden-to-close-guantanamo-permanently\/\" target=\"_blank\" rel=\"noopener\">published an open letter<\/a> urging Biden to permanently close Gitmo.<\/p>\n<p>&#8220;Whether Guant\u00e1namo and its injustices continue or\u2014as you promised\u2014end, will be a defining part of your legacy and this pivotal year of your presidency may be the last chance at closing it,&#8221; the letter states. &#8220;It is long past time for a meaningful reckoning with the full scope of damage caused by U.S. policies in response to 9\/11 and through the so-called &#8216;War on Terror.'&#8221;<\/p>\n<p>&#8220;Closing Guant\u00e1namo, ending indefinite military detention of those held there, and never again using the military base for unlawful mass detention of any group of people are necessary steps towards those ends\u2014and to combating dehumanizing and Islamophobic narratives,&#8221;
