Young \u2013 an appointee of former President Ronald Reagan \u2013 unsealed <a class=\"rm-stats-tracked\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.282460\/gov.uscourts.mad.282460.315.0_1.pdf\" target=\"_blank\" rel=\"noopener\">105 pages of documents<\/a> he initially kept under wraps because they contained details regarding federal investigations. Young granted a request by media outlets including the <em><a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/tag\/new-york-times\">New York Times<\/a><\/em> to unseal the files as a matter of public interest.<\/p>\n<p>Last year, Young <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/judge-strikes-down-trump-targeting-pro-palestine-students\" target=\"_blank\" rel=\"noopener\">ruled<\/a> that the Trump administration broke the law by targeting pro-Palestine student activists in a bid to \u201cunconstitutionally&#8230; chill freedom of speech.\u201d<\/p>\n<p>The unsealed documents include Department of Homeland Security (DHS) memos recommending that five student activists who were legally in the United States \u2013 Yunseo Chung, Mahmoud Khalil, Mohsen Mahdawi, Badar Khan Suri, and R\u00fcmeysa \u00d6zt\u00fcrk\u2014be deported, despite there being no evidence of wrongdoing.<\/p>\n<p>\u201cThere are few things more un-American than masked agents throwing dissenters in the back of a van because the government doesn\u2019t like what they have to say,\u201d Conor Fitzpatrick, supervising senior attorney at the Foundation for Individual Rights and Expression (FIRE) \u2013 which sued the administration over the unconstitutionality of its efforts \u2013 said Friday in a <a class=\"rm-stats-tracked\" href=\"https:\/\/www.thefire.org\/news\/unsealed-documents-prove-government-crusade-deport-ozturk-khalil-and-others-based-solely\" target=\"_blank\" rel=\"noopener\">statement<\/a>.<\/p>\n<p>\u201cBut these documents prove that it was the students\u2019 opinions alone, and not any criminal activity, that led to handcuffs and deportation proceedings,\u201d Fitzpatrick added. \u201cThe <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/tag\/first-amendment\">First Amendment<\/a> means the government cannot punish speakers for their opinions, but that is exactly what the government is doing.\u201d<\/p>\n<div class=\"embed-twitter\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Confirming everything we knew already; the Trump admin had a foreign student arrested by masked men on the streets and detained in a remote southern prison for co-writing an op-ed and NOTHING more. <a href=\"https:\/\/t.co\/V1uZeEdWZk\">https:\/\/t.co\/V1uZeEdWZk<\/a> <a href=\"https:\/\/t.co\/jbkUuyw3ez\">pic.twitter.com\/jbkUuyw3ez<\/a><\/p>\n<p>&mdash; Aaron Reichlin-Melnick (@ReichlinMelnick) <a href=\"https:\/\/twitter.com\/ReichlinMelnick\/status\/2014720720232734925?ref_src=twsrc%5Etfw\">January 23, 2026<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<div class=\"rm-col-center col sm-mb-1\">\n<div class=\"widget__body clearfix sm-mt-1\">\n<div class=\"body js-expandable clearfix js-listicle-body css-listicle-body-2675019679\" data-headline=\"'Confirming Everything We Knew Already': Docs Show Trump Admin Targeted Gaza Activists for Their Opinions\">\n<div class=\"body-description\" data-rm-calc-width=\"700\">\n<p>As the <em>Times<\/em> <a class=\"rm-stats-tracked\" href=\"https:\/\/www.nytimes.com\/2026\/01\/22\/us\/politics\/trump-rubio-student-speech.html?smid=nytcore-ios-share\" target=\"_blank\" rel=\"noopener\">reported<\/a> Friday:<\/p>\n<blockquote><p>The documents indicate that in nearly all instances, the arrests of the students were recommended based on their involvement in campus protests and public writings, activities that the Trump administration routinely equated to antisemitic hate speech and support for terrorist organizations. They also show that officials privately anticipated the possibility that the deportations might not hold up in court because much of the conduct highlighted could be seen as protected speech.<\/p><\/blockquote>\n<p>\u201cGiven the potential that a court may consider his actions inextricably tied to speech protected under the First Amendment, it is likely that courts will scrutinize the basis for this determination,\u201d stated <a class=\"rm-stats-tracked\" title=\"\" href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.282460\/gov.uscourts.mad.282460.315.18.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">one memo<\/a> on <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/mohsen-mahdawi-columbia\" target=\"_blank\" rel=\"noopener\">Madhawi<\/a>, a Columbia University student and permanent US resident.<\/p>\n<p>In another document, Trump administration officials admitted there were no grounds for deporting the students, but noted the Immigration and Nationality Act of 1952, which empowers the secretary of state to expel noncitizens whose presence in the United States is deemed detrimental to US foreign policy interests.<\/p>\n<p>Rubio cited the law to target pro-Palestine students for deportation, a stance that was rebuked in a June 2025 ruling from US District Judge Michael Farbiarz, an appointee of former President Joe Biden, who <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/trump-can-t-detain-mahmoud-khalil\" target=\"_blank\" rel=\"noopener\">found<\/a> that Khalil\u2019s \u201ccareer and reputation are being damaged and his speech is being chilled\u201d by the Trump administration\u2019s actions.<\/p>\n<p>In May 2025, US District Judge William Sessions III \u2013 who was appointed by former President Bill Clinton \u2013 <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/rumeysa-ozturk-release\" target=\"_blank\" rel=\"noopener\">ordered<\/a> the release of \u00d6zt\u00fcrk. The Turkish PhD student at Tufts University was <a class=\"rm-stats-tracked\" href=\"https:\/\/www.commondreams.org\/news\/trump-on-immigration\" target=\"_self\">illegally snatched<\/a> off a Massachusetts street in March 2025 and taken to a US Immigration and Customs Enforcement (ICE) lockup in Louisiana after she <a class=\"rm-stats-tracked\" href=\"https:\/\/www.tuftsdaily.com\/article\/2024\/03\/4ftk27sm6jkj\" target=\"_blank\" rel=\"noopener noreferrer\">published an opinion piece<\/a> in a student newspaper advocating divestment from apartheid Israel.<\/p>\n<p>\u201cThere has been no evidence that has been introduced by the government other than the op-ed,\u201d Sessions wrote in his ruling.<\/p>\n<p>One of the newly unsealed State Department documents <a class=\"rm-stats-tracked\" href=\"https:\/\/x.com\/prem_thakker\/status\/2014712253099004065\" target=\"_blank\" rel=\"noopener\">states<\/a> that DHS and ICE have \u201cnot provided any evidence showing that \u00d6zt\u00fcrk has engaged in any antisemitic activity or made any public statements indicating support for a terrorist organization or antisemitism generally.\u201d<\/p>\n<div class=\"embed-twitter\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Remember how Rubio lied by saying she was detained for campus violence and not for writing an oped <a href=\"https:\/\/t.co\/S4aweXz6pW\">https:\/\/t.co\/S4aweXz6pW<\/a> <a href=\"https:\/\/t.co\/1a8GdOR1f6\">pic.twitter.com\/1a8GdOR1f6<\/a><\/p>\n<p>&mdash; Brian Tashman (@briantashman) <a href=\"https:\/\/twitter.com\/briantashman\/status\/2014751261422215464?ref_src=twsrc%5Etfw\">January 23, 2026<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<p>Fitzpatrick stressed that \u201cthis can\u2019t happen in a free society.\u201d<\/p>\n<p>\u201cIt can\u2019t happen in a free America,\u201d he added. \u201cWe\u2019ll continue to fight this egregious violation of the Constitution every step of the way.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge on Thursday unsealed documents showing that US Secretary of State Marco Rubio personally approved the deportation of university students after receiving memos highlighting their involvement in constitutionally protected campus protests against Israel\u2019s genocide in Gaza.
