SUBJECT: Those “Damn Emails” – “Really a Concern”

Introduction

Last Wednesday Robert Gates, CIA Director under President Bush-41 and Defense Secretary under President Bush-43, publicly commented that Secretary Hillary Clinton’s “whole email thing … is really a concern in terms of her judgment,” adding, “I don’t know what originally prompted her to think that was a good idea.”

What originally prompted her does not matter. As your Secretary of State and your subordinate, she willfully violated laws designed to protect classified information from unauthorized disclosure. It may be somewhat difficult for those not as immersed in national security matters as we have been to appreciate the seriousness of the offense, including the harm done in compromising some of the most sensitive U.S. programs and activities. This is why we write.

Pundits and others are playing down the harm. A charitable interpretation is that they have no way to gauge what it means to expose so much to so many. We do know, and our overriding concern is to protect the national security of our country from further harm. It would be a huge help toward this end, if you would order Attorney General Loretta Lynch to instruct the FBI to stop slow-walking the email investigation and release its findings promptly.

SUBJECT: Veteran Intelligence Professionals Challenge CIA’s “Rebuttal” on Torture

Former CIA leaders responsible for allowing torture to become part of the 21^st Century legacy of the CIA are trying to rehabilitate their tarnished reputations with the release of a new book, Rebuttal: The CIA Responds to the Senate Intelligence Committee’s Study of Its Detention and Interrogation Program. They are pushing the lie that the only allegations against them are from a partisan report issued by Democrats from the Senate Intelligence Committee.

We recall the answer of General John Kimmons, the former Deputy Director of Operations for the Joint Chiefs of Staff, who was asked if good intelligence could be obtained from abusive practices. He replied: “I am absolutely convinced the answer to your first question is no. No good intelligence is going to come from abusive practices. I think history tells us that. I think the empirical evidence of the last five years, hard years, tell us that.”

But the allegation that the CIA leaders were negligent and guilty was not the work of an isolated group of partisan Democrat Senators. The Senate Intelligence report on torture enjoyed bipartisan support. Senator John McCain, for example, whose own encounter with torture in North Vietnamese prisons scarred him physically and emotionally, embraced and endorsed the work of Senator Feinstein. It was only a small group of intransigent Republicans, led by Saxby Chambliss, who obstructed the work of the Senate Intel Committee.

SUBJECT: Releasing an Intelligence Report on Shoot-Down of Malaysia Airlines Flight 17

It has been a year since the shoot-down of Malaysia Airlines Flight 17 over Ukraine, resulting in the death of 298 passengers and crew. The initial response by the U.S. government supported the contention that the likely perpetrators were anti-government forces in southeastern Ukraine (the customary media misnomer for them is “separatists”), and that they were possibly aided directly by Moscow.

On July 29, 2014, we Veteran Intelligence Professionals for Sanity (VIPS) suggested that the United States Government report publicly what intelligence it actually had relating to the shoot-down lest the incident turn into another paroxysm of blaming Russia without cause. We are still waiting for that report.

U.S. intelligence veterans recall the real story of how New York Times reporter Judith Miller disgraced herself and her profession by helping to mislead Americans into the disastrous war in Iraq. They challenge the slick, self-aggrandizing rewrite of history in her new memoir.

SUBJECT: A New “Miller’s Tale” (with apologies to Geoffrey Chaucer)

On April 3, former New York Times journalist Judith Miller published an article in the Wall Street Journal entitled “The Iraq War and Stubborn Myths: Officials Didn’t Lie, and I Wasn’t Fed a Line.” If this sounds a bit defensive, Miller has tons to be defensive about.

In the article, Miller claims, “false narratives [about what she did as a New York Times reporter] deserve, at last, to be retired.” The article appears to be the initial salvo in a major attempt at self-rehabilitation and, coincidentally, comes just as her new book, The Story: A Reporter’s Journey, is to be published today.

In reviewing Miller’s book, her “mainstream media” friends are not likely to mention the stunning conclusion reached recently by the Nobel Prize-winning International Physicians for the Prevention of Nuclear War and other respected groups that the Iraq War, for which she was lead drum majorette, killed one million people. One might think that, in such circumstances – and with bedlam reigning in Iraq and the wider neighborhood – a decent respect for the opinions of mankind, so to speak, might prompt Miller to keep her head down for a while more.

In all candor, after more than a dozen years, we are tired of exposing the lies spread by Judith Miller and had thought we were finished. We have not seen her new book, but we cannot in good conscience leave her WSJ article without comment from those of us who have closely followed U.S. policy and actions in Iraq.

The original idea of the CIA was to have independent-minded experts assessing both short- and longer-term threats to U.S. national security. Mixing with operations and politics was always a danger, which is now highlighted by CIA Director Brennan’s reorganization, opposed by a group of U.S. intelligence veterans.

SUBJECT: John Brennan’s Restructuring Plan for CIA

Mr. President, the CIA reorganization plan announced by Director John Brennan on Friday is a potentially deadly blow to the objective, fact-based intelligence needed to support fully informed decisions on foreign policy. We suggest turning this danger into an opportunity to create an independent entity for CIA intelligence analysis immune from the operational demands of the “war on terror.”

On Feb. 5, 2003, immediately after Colin Powell’s address to the UN, members of VIPS sent our first VIPS memorandum, urging President George W. Bush to widen the policy debate “beyond the circle of those advisers clearly bent on a war for which we see no compelling reason and from which we believe the unintended consequences are likely to be catastrophic.”

The “former senior officers” whom Brennan asked for input on the restructuring plan are a similar closed, blinkered circle, as is the “outstanding group of officers from across the Agency” picked by Brennan to look at the Agency’s mission and future. He did not include any of the intelligence community dissidents and alumni who fought against the disastrous politicization of intelligence before the attack on Iraq. Nor does Brennan’s plan reflect the lessons learned from that debacle.

Sen. Mark Udall has called for the full release of the Senate Intelligence Committee’s report on torture. However, as a still-sitting member of Congress, he has a constitutional protection to read most of the still-secret report on the Senate floor – and a group of intelligence veterans urges him to do just that

SUBJECT: Stopping Torture

We, the undersigned are veteran intelligence officers with a combined total of over 300 years of experience in intelligence work. We send you this open letter at what seems to be the last minute simply because we had been hoping we would not have to.

You seem on the verge of leaving the Senate without letting your fellow Americans know all they need to know about CIA torture. In the eight weeks since you lost your Senate seat you gave off signs that, during your last days in office, you would provide us with a fuller account of this sordid chapter in our country’s history, exercising your right to immunity under the “Speech or Debate” clause in Article 1 of the Constitution.

Your rhetoric against torture and in defense of the Constitution has been strong, but we now sense a white flag beneath it. We fear you intend to silently steal away, and thus deny the American people their last best chance to learn what they need to know about the record of CIA torture.
