In late 2006, Congress revised the Posse Comitatus Act and the Insurrection Act to make it far easier for a president to declare martial law. Those changes were repealed at the end of this January as part of Public Law 110-181 (HR 4986), the National Defense Authorization Act for Fiscal Year 2008 (signed into law by President Bush on January 28, 2008).
Senator Patrick Leahy (D-Vt), who championed the opposition to the original law, was also the hero of the repeal. It helped that all the nation’s governors opposed the 2006 law.
Boise State Professor Charlotte Twight, the author of the excellent Dependent on DC, alerted me to the change last night. I checked on Nexis and the only news coverage I found regarding the repeal was a 322-word Gannett News wire story from February 1 that focused on how the repeal made governors happy.
I first wrote about the Posse/Insurrection peril for American Conservative a year ago. My most recent piece on the subject was an article for the January issue of the Future of Freedom Foundation’s (FFF) Freedom Daily. The law was changed between the time the piece was published and when FFF posted the January article online on April 9.

NSPD-51/ HSPD-20 appears to supersede the National Emergency Act by creating the new position of National Continuity Coordinator without any specific act of Congress authorizing the position.
NSPD-51/ HSPD-20 also makes no reference whatsoever to Congress. The language of the May 9 directive appears to negate any a requirement that the president submit to Congress a determination that a national emergency exists, suggesting instead that the powers of the executive order can be implemented without any congressional approval or oversight.
I got to thinking this morning. I have a lot of free time, but anyway I had a thought about the whole loss of liberties:

Another problem we are facing is that the vast majority of Americans don’t want to see the problem because they are afraid to look at it. If they acknowledge the problem, they are admitting there is one and they don’t know how to deal with it. Seriously, how many write their legislative reps? I write mine although it seem to be an exercise in futility. I also read the bills they are voting on. It is how I spend my time and I like to be at least aware of what is being passed in the state legislature.
As for the big bang; what was your initial reaction when you heard the news on 9/11? I was laying in bed when I heard in the radio that the WTC was hit by a jet airliner. When I went to see the news on television, my reaction was somewhat detached question; “Why is the government doing this?†That was my reaction and I am serious about it. Just a larger version of the Oklahoma City Bombing.
What was America’s reaction? The “patriotic†flag waving of course and that was pretty much it. Immediately afterwards, ANYONE who dared question the party line was considered a traitor. I remember the lack of criticism and the wave after wave of pure B.S. coming from our Glorious Imperial leader and his cronies.
What about the next “event†if there is one. If it is in the shape of a mushroom cloud, what will be the reactions of the vast majority of Americans, oh say around 250 million of them all waving their flags? What if the event is what we are seeing now? The collapse from within. The economic collapse which makes Americans into a nation of homeless individuals and displaced families.
What makes me fearful is that the banks, industrialists and property owners may sell their holdings quite literally to the highest foreign bidder. The politicians/CFR lackies and Bilderberger elite will say that the investment of foreign capital will be what will save America from collapse and worse yet, the sheeple who are sitting in front of their televisions will be either to ignorant of the facts or to gullible will go along with it. They will have conquered America without firing a shot. Already there is mumblings in the media about a global bailout fund.
Hell, they may not even declare martial law at all. They may just keep things running just well enough to keep the people from thinking about a revolt but just bad enough to where the people can’t get up out of the economic mire they are in. They (the shadow masters), won’t have to worry too much so long as there is television just good enough to watch and keep the people sitting in front of it so they won’t be doing anything meaningful like learning the truth about things.

First there was the infamous 1200 page Patriot Act that appeared a few days after 9-11 but almost no one on Capitol Hill took time to read, but almost everyone signed off on it anyway. Some on Capitol Hill have said that soldiers with machine guns were in the hallways on Capitol Hill the night the Patriot Act was signed, and many felt intimidated they must sign it without reading it. If true, then it implies that martial law may have already been declared in secret. Soldiers in hallways have no place on Capitol Hill in civilian government. Again, another sign of a dictatorship IN ACTION.
Technically, Congress could nullify the Patriot Act overnight by claiming it was signed under duress……’

Thanks Rusty. I understand where you were coming from, when I read this article that brought me here this morning, I was furious. Then to read comments like, “Good News”, this upset me more. I want people to realize we have been and are still being lied to. It is time for us all to get our preparations in order. I heard people talking about standing up. Any plans? Colonies, in particular, were expected to buy all the things they needed of the mother country. This theory, backed by the interests of the ruling class of England, is the explanation of the Navigation Laws, which are commonly given as one of the principal causes of the Revolution.
The recent war had left England with a crushing debt. This was an added reason for seeking to raise revenue in America and for confining American trade to British ports.
Each of the colonies had some especial interest that came into sharp conflict with the actions of the British government. New England, the head and front of the Revolution, had many very serious grievances, although some of them would hardly be looked upon as purely patriotic by those who fix opinions in present society. We have already seen how completely New England was dominated by commercial and fishing interests. Her “great men” were all merchants. But their trade was not conducted in a manner that is commonly supposed to carry social preeminence. David H. Wells, in his article on “American Merchant Marine” in Lalor’s “Encyclopedia of Political and Social Science,” describes these merchants and their trade as follows : –
“Nine-tenths of their merchants were smugglers. One quarter of all the signers of the Declaration of Independence were bred to commerce, the command of ships, and the contraband trade. Hancock, Trumbull (Brother Jonathan), and Hamilton were all known to be cognizant of contraband transactions, and approved of them. Hancock was the prince of contraband traders, and, with John Adams as his counsel, was appointed for trial before the admiralty court of Boston, at the exact hour of the shedding of blood at Lexington, in a suit for $500,000 penalties alleged to have been incurred by him as a smuggler.”
Like all smugglers, Hancock cared little for the forms of law, and trusted to bribery and violence to secure his ends. When his sloop, Liberty, was endeavoring to run the customs, he first tried to bribe the officials, and, this failing, locked up the guard in a cabin and unloaded the sloop under the protection of a gang of thugs secured for the occasion.
For many years this smuggling had been winked at by British officials. The smugglers were not averse to dividing their profits to a limited extent with complaisant officials, and England was a long way off in the days of sailing vessels. Even in England there had been a laxity in the enforcement of smuggling laws, which now suddenly ceased. In England enforcement of the laws caused little more than a suppressed grumbling. In America it led to rioting and then to revolution.
In America the suppression of smuggling meant the suppression of the commercial life of New England. We have already seen that one of the principal items of commerce was the famous three-cornered rum-molasses-slaves trade. One of the first of the new taxes was a prohibitive tariff on the molasses from which the rum was made.
Those citizens of New England who were not concerned with commerce were generally interested in fishing, and here again the new legislation struck fatal blows. The
trade with southern Europe was forbidden, and for a time the New England fishers were not permitted to use the Newfoundland Banks.
Another important and profitable article of smuggled commerce was tea. This was brought from Holland. Here the interests of the English governing classes came into direct and sharp conflict with the American smugglers. The East India Company had a monopoly of the tea trade. This company was owned by court favorites. It was threatened with bankruptcy. It had 17,000,000 pounds of tea stored in English warehouses. On this it was required to pay a shilling a pound before it could sell it in England. The English government proposed a scheme by which this tea could be sold in America for less than it would cost the Englishmen who paid the local tax.
The orthodox schoolbook histories assure us that this offer of cheap tea to Americans was an attempt to “bribe a nation,” and that the Americans indignantly rejected the bribe and threw the tea into Boston Harbor in defense of a principle. This high-minded rejection of a bribe by John Hancock, the man who was mainly responsible for the famous Boston Tea Party, is scarcely in accord with what we have learned of his character. The fact is that had the tax not been reduced there would have been little objection. It was the reduction itself and not the principle which raised the famous riot. So long as the East India Company was compelled to pay the English tax, the American smugglers could undersell it and were not worried about questions of taxation, or patriotism. But when the tax was rebated the East India Company could undersell the smugglers. This destroyed the profit in smuggling, something infinitely more effective in checking that crime than a whole fleet of gunboats. No wonder that Hancock, whose popular title was the “prince of smugglers,” called a mass meeting and with the aid of Samuel Adams organized that glorious mob that dumped the tea in Boston Harbor and started the Revolution, – at least, so the textbooks tell us….

Impeachment is really quite simple constitutionally, as Mr. Paul noted when Clinton was impeached.
A majority vote of the House suffices on whatever charges the House deems to be “high crimes and misdemeanors”.
No investigation necessary. No judicial process. No muss, no fuss, no bother.
The Senate then tries, according to whatever procedure it chooses.
Penalty is removal from office.
Impeachment is constitutionally excepted from the protections of trial by jury.
There is no judicial appeal.
Perhaps Mr. Paul is waiting for an opinion from John Yoo in regard to whether a sitting president is constitutionally impeachable during a state of “quasi-war”, especially if he happens to be Republican?

Smuggling tea
By the middle of the 18th Century, the tax on tea had reached a staggering 119% – much higher than most British taxes today. Naturally enough, this was very unpopular among a tea drinking population.
So smuggling into Britain began, to evade taxation. Because of the popularity of tea, many types of people became involved in the smuggling. Smuggled tea came mainly from Holland and Scandinavia, brought over by Dutch and Scandinavian merchant ships to anchor off English and Scottish coasts.
Taken ashore by fleets of small craft crewed by local fishermen, the tea was smuggled inland, often through underground passages or along hidden pathways. Often the best place for storage was the local church.
Even smuggled tea was expensive, however, and by 1777 could cost anything up to 10s 6d (53p) per pound – about one-third of the average weekly wage at that time. Because of this cost, and because tea was both popular and profitable, the practice of adulteration began, even though banned by Act of Parliament in 1725. Adulteration saw new pure tea mixed with old tea leaves, recycled tea leave and other substances, including dung.
Despite numerous attempts by the government to crack down on tea smuggling it remained profitable and very common until 1784. In this year the government of William Pitt slashed the tax on tea from 119% to 12.5%. However, the practice of adulateration still remained profitable and would continue to be common pratice until 1875 when the English Food and Drug act where passed which imposed heavy fines and imprisonment for committing the act.
Tea and the American Revolution:
England had recently completed the French and Indian War, fought, from England’s point of view, to free the colony from French influence and stabilize trade. It was the feeling of Parliament that as a result, it was not unreasonable that the colonists shoulder the majority of the cost. Thus the British government imposed a number of new taxes to help pay for the war and also the continual garrison of British troops and naval ships in the thirteen colonies. They imposed higher tax on Newspapers, Tavern Licenses, legal documents, marriage licences and docking papers. The colonists rebelled against what they saw as arbitrary taxation without representation. In response Parliament imposed even heavier taxes including in June 1767 a tax on tea.
In response to these news taxes the American colonists started to openly purchase imported Dutch tea. Which was circumventing the East India Companies monopoly of all tea sales to England and to her colonies. The financially troubled John Company granted permission to sell directly to colonist, by-passing colonial merchant, resulting in a profit windfall. The East India Company was counting on the passion of American Women for tea to result in the Dutch getting cut out of the tea market, British warships where also employed to reduce Dutch tea entering the colonies. This was a major calculation as American Women and the population as a whole boycotted British Tea. Thus tea became a major rallying call and a symbol of non-representative and a repressive government abroad and would lead to revolution and the creation of new nation….

You guys are more worried about your own government than you are about Bin Laden and the Islamo Fascists that want to destroy this country.
Many people feel like there’s a war coming to this country, and there is. But of course nobody wants to throw the first blow and get blamed for insurrection or starting a riot. After all, most good people are sensible and prefer peace. But there is a cause for action right now, and taking this action will not result in massive civil discord. What is more, no war has ever been won fighting only defensive operations, because the advantage of surprise and initiative goes to the attacker, and well directed attack is necessary to break the enemies war making power. The traffic in sex slaves and hard drugs is the target of opportunity for anyone who wants to change this war from defense to attack. It is the direct source of the power which corrupts our government. Obviously, the government and military are directly involved, or the business would not go on in such obvious untouchability. However, unlike the non-option of a frontal attack on the corrupt courthouse, military base or Sheriffs department, the vigilante execution of underworld criminals will not spur public outcry. In fact, it stands to serve the purpose of cleaning up government through the back door and will generate overwhelming sympathy and popular support.
Every man and woman who is looking the other way for these heinous criminals is an accessory to their crimes. But those who are caught red-handed, maybe literally with blood,
need to die then and there. There are no courts in the land that are beyond the reach of these most pervasive and dreadful criminal elements, and thus there is the need and obligation to carry out vigilante justice and to make war against this inhuman bunch of traitors. The object is not to give them what they deserve, which is to be tortured to death slowly over and over again, but to put them to death quickly and efficiently in accordance with Law. Death may be too good for their likes, but they won’t come back from it and that’s the point. Typically, one should see if they surrender when caught. From a moral stand point we don’t want people to see us as gruesome murderers, so they should be hung in a visible location bearing placards around their necks describing the crime they were caught red-handed in. A heinous criminal caught in the act needs no trial, as any trial around sex slavery or massive drug importation will be unduly influenced by the corruption already systemic in government and would result in the criminal walking, and the vigilante getting life.
Everybody is afraid of these bad guys, they say. But I say we are everywhere, we are strong, and they are weak liars who use fear as a weapon. I am calling for an unorganized, cellular, grassroots based war against the traffickers in human bondage and hard drugs. They can never infiltrate and destroy us, because we will stubbornly remain unorganized beyond the smallest unit needed to do the job. United in spirit, we will act as one. Through the blessings of providence our effects will greatly multiply. If we start the offensive this summer, they will be panicking and in disarray by winter. We need to get the word out that it’s open season on these scumbags because only combined attack from many directions will break their power and keep them from regrouping with a vengeance. This attack will translate into progress politically when the crooks realize their time grows short, and the corrupt people in government who get caught in our operation are found hanged themselves, in a situation in which is abundantly clear that they are guilty. To that end, would be vigilantes must remember to make videos when possible of a bust and execution, providing both evidence of our lawful conduct, and good propaganda to be duplicated and passed around.
Satanistic heartless murderers are often very dangerous people, but this should only be a strategic consideration, not a reason to fail to confront. They may be military people, or police or prominent masons. They might be mafiosis in the classic sense, or appear as homeless crazies. They might ever appear as bull dyke child protection workers or other unexpected things. In any event, it is the responsibility of anyone embarking upon this mission to ensure that the target is the right one, and to gather evidence leaving little room for doubt. They will at first try to counterattack, using surveillance, kidnapping and poisoning. But since they are doing this all the time anyway, there will be no hope if we desist in our attacks. We must start as soon as possible, and carry through our effort to their utter extermination. We cannot coexist with inhuman monsters who prey upon the young. If this costs anyone good their life, they can die knowing they struck the first blow for liberty in the 21st century.

For the first time in history, the level of consciousness of mankind as a whole ,suddenly jumped to a hopeful level of 207 in the mid-1980’s . The scale of consciousness shown on pages 68-69, goes from 0-1000, shame to enlightenment, with integrity and courage at 200 which is the transition level to ascending consciousness. The critical response point in the scale of consciousness calibrates at level 200, which is the level associated with imtegrity and courage. All attitudes, thoughts, feelings….. below that level of calibration make a person go weak-those that calibrate higher make subjects go strong .

I read the first 10 or so pages (lists contents) and there is nothing even close to how this would be described.

Some Items on the so called REX 84 previously mentioned
I have spent considerable time researching this and COG and the whole history of governmental prepardness.
REX 84 was not a directive, but in fact was a preparedness exercise done by the Government. It was in fact preceded by REX 83, 82, 81, 80 and 79 and went on to REX 85, 86, 87, 88, 89 and so on through present. It went by a different name previous to 79, but in went back even further. Of late the name has changed again but the principle is the same.
Note REX-80 Alpha (during the Carter Admin) dealt with such issues of how survivors would pay taxes during a post nuclear strike. As I recall from the docs, taxes would be exempted during the year of the strike, then after that the government would take a certain percentage of all goods and services produced by the individual. Kind of like a flat tax.
Back during the Reagan years, the REX exercises dealt with issues such as what would happen during an after a nuclear strike on the United States and included various scenarios, including the one used in REX 84 which included the rounding up of ILLEGAL Aliens and putting them into detention camps. This was not the first time the “round up†and “detention camp†story made the rounds.
REX 84 did not come from Oliver North or the Iran Contra hearings. If you check out the original article that appeared in the July 5, 1987 Miami Herald titled Reagan Aides nd the Secret Government you will see that REX is not mentioned, however a contingency plan had been hatched to suspend the Constitution in times of National Emergency. This was nothing new and incredible Lincoln in essence suspended part of the Constitution during the Civil War, FDR did during WW 2, and every President since Truman had some kind of contingency plan that assumed we would no longer have a Constitution. In April of 1952 Harry Truman signed an EO, 10346 which called for and mentioned “continuity of governmentâ€
Back in the late 40s some agencies of the Federal government including the FBI floated plans of rounding up the communists and people whom were considered to be enemies. There were some “camps†that were sort of setup, but nothing in full operation as that really didn’t go anywhere at the time. Turned down at the executive branch level. Discussions of internment and camps all but died off at the governmental level for MANY years after that. Keep in mind that FDR sent the Japanese Americans to internment camps during WW-2 a fact that the Supreme Court held up that he could do.
A side note here. On December 6th 1941 the press, as I recall the Chicago newspaper, had a story about some war planning the FDR administration was doing called Rainbow, which called for the invasion of Canada and the internment of POWs and Canadian citizens. There was even a plan at one point for the U.S. to invade Britian. I would point out that in the bowels of the U.S. Government there is probably some preparedness plan for invading somebody and interning people. War gamers I talked to advised me that there are constant games going on all the time
Outside rumors (meaning people off the street blabbing stories) camps and roundups died down for quite awhile until the 60s when stories started circulating around that the then radicals, the Black Panthers and anti war demonstrators were going to get rounded up by the Johnson administration and put in camps. Later it was the Nixon admin, and communists were included in the story. After Nixon left and Ford was President, it also included the Black Panthers, Weather Underground, and anybody affiliated with communist type activity.
Once Carter was elected, the story was repackaged and retold, dropping the leftist radicals as the target of the internment and instead fingering gun owners and Christians. This continued through to Reagan. Then according to the rumors and stories, spread by various people it was the leftist type groups and organizations then became the “target†of the roundups and camps. During the time the government ran many preparedness drills, including REX 80 and every year thereafter. REX 84 was a nuclear post strike drill and supposedly REX 84 called for the internment of 400,000 illegal aliens. Keeping in mind that the U.S. Government had just been over run by a load of Cuban refugees in the 70s and 80s, this seemed like a plausible scenario to include. The first so called alleged leak about REX 84 came from a newspaper called The Spotlight. They had some information correct, a lot not. But that was the ‘actual†start of the many and various REX 84 rumors.
Eisenhower had it set up that 13 unelected men would take over running portions the country after a major nuclear strike. JFK terminated these men’s authority, and then lined up his own unelected people to do the same. Every President since then has done this.
Bush’s Order on preparedness was merely his modification of the existing one that was in effect under Clinton. Clinton did two of them that modified what Bush Sr did. Bush Senior did one, which modified what Reagans did. Reagan did one that modified what Carter’s did and so forth all the way back.
Every President has had his preparedness order, some Executive (as was the case with Nixon) and some by signed directive with their various modifications to it. These modifications referred to the feeling of the times. For example from Truman to Bush Sr, the theory was the US would get nailed with a giant Soviet First Strike that would wreck the country. After Bush Sr. declared the Cold War over, these plans changed to reflect what Presidents and advisors perceived would be the crisis of the day. Needless to say under Bush Jr. the issue is not nuclear strike, but the war on terror and the order reflects that.
Interestingly under Reagan the planning went back to the original COG or Continuity of Government. During one exercise they were holding, communications weren’t working at the command post level. This was not intended as I recall. So people were left running out from the command post to a public pay phone to relay data. Not very practical had actual nukes gone off. As they toiled and planned further, they came to the realization that there were certain unsurmountable issues involved with Continuity of Government. For example if everybody in the chain of command from the President on down got fried in a nuclear strike (say at the state of the Union address) and the designated cabnet official that leaves town during that address also got killed, how to convince the American public that somebody like Jean Kirkpatrick (UN Ambasador) was now President. Or how do you convience the people that General so and so is now President because he survived the strike in his airborne command post. The bottom line they found out is this stuff looks great on paper but the practical application probably wouldn’t work.
Bottom line is that if this nation were to face a Katrina style destruction and disruption on a full national level of our country, nation government would be in essence non functional and we would be on our own for quite awhile. This is an area of scenario that I have followed. You would have pockets of the country forming their own governments, own Constitutions, own rules. You would have various, shall we say ambitious people, coming out of the wood work wanting to be President of that area, i.e. pulling the level of power etc etc. For example in California you might have various liberal leaning people wanting to be President and ordering the round up and detention of conservatives and others that didn’t agree with them. In Arizona you might have a Hispanic person being in charge and ordering the round up of other races. The list could be long and endless.
Point is that most of these directives look nice on paper, they serve a function, but in practical terms are not useable in any sense of the word UNLESS the disaster is say just greater then Katrina, but much smaller then a nation wide type disaster.
The question is that how are the orders implemented? Well the President signs them into place. Various agencies in the government make their plans around that guidance. Now should a disaster happen, whomever is left pulls up these orders and puts them into play. However the “new†or old president could look at the orders, say this doesn’t fit the situation at hand, round file the previous orders, and do his own thing. So in essence they are fancy guidance nothing more.
The likely hood is that if some nation wide emergency happens, history will record that whomever the President had difficult decisions to make, with not enough information, during a time when the entire national infrastructure is down or missing. It will probably record that they used some of the guidance in the orders but had to make tough decisions and modify others depending on what the situation in the nation was doing or not doing.
So what can WE expect in the future. We will probably hear during the spring of this year some whispered tale about an attack on Iran. The tales typically die off during the summer months and will pick back up in Sept/Oct. (Note the attack Iran tale has been circulating since 2001, usually every spring and every fall) I would expect us to hear some incredible tale about some so called October Surprise that is floated either on talk radio or the Internet. It usually comes from some so called insider, or somebody with some so called insider connection whispering to us how there is some October Surprise scenario going to happen in Sept or October of 2008, or how Bush/Cheny is going to declare martial law and take over the country, blah blah blah.
Another story goes something along the lines of some high ranking military officers (generals or admirals) are going to revolt/have a coup if….blah blah blah isn’t met, or doesn’t happen. That particular story started late in the Reagan years, then Bush Sr, then Clinton in 1996 then again Clinton during 2000, Bush Jr in 2004 and now I expect it to resurface in 2008.
NO MATTER who the next President is, there will be some people talking about martial law, detention camps, impeachment and all the other stories and tales that circulate and thus we reset for the next four years with people and their various tales and stories.
